Depending on the nature of your injuries, you may qualify for temporary partial disability benefits and temporary or permanent total disability in the amount of 66% of your wages for up to 520 weeks. Louisiana’s workers’ compensation covers a full range of physical injuries and several types of mental suffering.

Your employer may be exempt from workers’ compensation requirements. If you are an employee working for a private residence, farm or a nonprofit organization, or are a miner, real estate broker, musician or performer, you may have to seek remedies in court for your injuries. Longshoremen, seamen, cruise industry workers may qualify for compensation through the Longshoremen’s and Harbor Workers’ Compensation Act, the Jones Act, or the Federal Employer’s Liability Act.

Workers’ Compensation Requirements

Most Louisiana employers are required to carry workers’ compensation insurance to pay for your medical expenses when you are injured at work. You also have a right to permanent or temporary disability benefits until you can safely get back to your job. In exchange for these benefits, you cannot bring a lawsuit against your employer for your workplace injuries, and your employer cannot sue you.

There are time restrictions to file a claim and there are financial limits for workers’ compensation benefits. You will need to give your employer the notice of your injury within 30 days from the date of your injury. If you do not give the notice, you may not be able to collect financial compensation. Your employer’s insurance company must make workers’ compensation benefits payments within one year of your accident at work. The workers’ compensation system and the various exemptions in Louisiana can be difficult to navigate on your own without the help of an experienced advocate.
